* FC2 Website Terms of Use

• To begin with...
• Registered users can have up to 1GB of Website space.
  
• 1:[ Exemptions ]
• For the following items, we would not bear responsibilities at all.
• 1.Users have to bear full legal responsibility for the contents of one's Website. Users are obligated to promptly remove the contents whose nature is in the violation of U.S or Japanese laws, offensive to others, harmful for other's privacy, copyright, and public order. Administrators do not have to guarantee the contents in their accounts, and have no responsiblilities for any other third parties.
• 2.We ask each user to back up data of your Website, for any unexpected disruptions.
• 3.Deeds that violate domestic laws, copyrights of images, article, music, software, and etc.
  It is strictly prohibited to upload materials that are protected under copyright, registered trademark, patent law, and etc without recognition of each owner. The same is applicable to the contents that solicit climinal activities, include obscenity and violate copyright. Please keep in mind that such Website can be deleted at any given moment.
  
  *Publish .rm or .mp3 files that are conversion of copyrighted CDs.
  *Publish .mid file of songs whose copyright does not belong to the user without recognition.
  *Publish movies or images from TV and CMs.
  *Publish file or serial number of softwares, etc.
  
  Pirated files would immidiately be eliminated even if they are not applicable to these 4 examples.
• 4.Please understand that these terms of use will be modified from time to time without any prior notification to users.
• 5.For any troubles through the use of this service, FC2 is not involved. It is fully up to each user to maintain his/her contents, thus FC2 cannot make compensation for any damages caused to visitors to one's Website. Especially the Website concerns selling/buying of items, administrators have to clarify the relationship to their users. Problems have to be completely prevented or settled among concerned users.
• 6.FC2 does not bear an obligation to censor and delete its users' Website.
  Users have to be fully responsible for all information on their Websites, and FC2 would not be responsible for any damages to other users that arose from the act of omission of users.
• 7.Exceeding 10 times of average bandwidth of all users, or disrupting other users access may cause cancellation of your acount without notice.
• 8.Information given to us (i.e. address, name, e-mail address, phone number, fax number) will not be disclosed to others without recognition from users.
  However, we may disclose it in the following occasions.
  a). When a user has agreed to disclose his/her personal information.
  b). When it is deemed as necessary to disclose his/her personal information.
• 9.All users who acquired access to an acount have to acknowledge and be conscious of precision, perfection, convenience and all the danger related to the contents uploaded onto this service. FC2, in its sole discretion, has the right to remove all the contents that are deemed to be dangerous, offensive, null and void in the light of our terms of use.
  FC2 takes on no responsibility for the contents whih have been uploaded to all the relevant contents of FC2 (to name a few, individual website, blog, media, comment) by the users.
• 2:[ Prohibitions ]
• 1. Use it as a file-storage
  We prohibit users from making use of their websites as a storage to store movie, image, and music files. Please note that we may delete the website without "index.html" file or where more than 80% of the website is occupied with images.
• 2. Expressions or acts against public order
  It is strictly prohibited to publish movies, sounds, and letters whose nature is obscene or sexual. Also pornographies, nude or other images that can be harmful for minors are banned. If a website is found to be applicable to the description, FC2, on its own sole discretion, can eliminate it without any prior notice.
• 3. Contents or deeds that violate copyright and domestic laws.
  It is strictly prohibited to upload materials that are protected under copyright, registered trademark, patent law, and etc without recognition of each owner. The same is applicable to the contents that solicit climinal activities, include obscenity and violate copyright. Please keep in mind that webpages with any of mentioned contents can be deleted at any given moment.

• 4. Providing contents that are aggresive to certain communities.
  It is prohibited to act in a way that degrades certain person, community, item, and consequently harms their dignity and credit.
• 5. Disclosure of private information, violation of copyright
  It is prohibited to post information on one's privacy. (e.g. address, phone number, password, credit card number, etc)
• 6. Excess of Upload (more than 1GB)
  Many users are sharing limited space in the server. We sincerely ask you not to upload more than 1GB, with consideration to others. If found as violation, the Website may be eliminated without notice.
• 7. Webpage that has not been updated for more than 3 monthes
  Users or websites that have not been updated for more than 3 monthes will be deleted.
• 8. Disrupting other members' use and the like.
  We would like all user to enjoy the service. With this perspective, all acts below are banned. Please note that acts that do not fall onto the below can still be eliminated as well.
  
  • Distribution of virus or any other factors that affect PC or the server.
  • Upload of a file that is restricted or requires password to view.
  • Creation of Website that is harmful in any terms when viewing.
• 9. Hiding or relocation of "Powered by FC2"
  Even a relocation to a line below is found to be violation. In order to clearly display the compnay name, FC2 would eliminate or block access to the website without notice.
• 10. Password requirement on the homepage
  Webpages whose homepage is restricted and require password will be immidiately deleted without notice.
• 11. Exceeding 10 times of average bandwidth of all users
  Should users do not lower the bandwidth despite of our warning, they might be banned from any use of the service.
  
• 12. Prohibition on spam activities
  FC2 may block or delete the account of users who have committed in spam activities (i.e. creating webpages without contents) and been seen as inapropriate as an administrator.
  
• 13. Actions that promote accesses to unlawful materials
  Through the use of this service, it is strictly prohibited to upload, distribute, save materials that are deemed to be unlawful.
  Should this be found by FC2, in its sole discretion, FC2 blocks and eliminates accounts of the users.
  
  Examples of this is, but not necessarily limited to,
  * Contents that imply either direct or indirect offence, threat, child pornography, child prostitution.
  * Contents that have been refered without any permission, but have been protected under copyright, trademark right, etc
  
• 14. Any actions that are inherently offensive to the minors.
  

• 3:[ Conflict Settlement ]
• *These terms of use shall be governed by and construed in accordance with the laws of the state of Nevada, the United States of America. For all conflicts or claims arose from the use of this service, these will be sumbmitted to the arbitration process stipulated in the law of the state of Nevada. Cases that could not be settled through the arbitration process have to submit its jurisdiction to the District Court of the State of Nevada. Under such circumstances, District Court of the State of Nevada will be the exclusive jurisdiction for the first trial. Any costs that arise from the process have to be born by respective party.
• *Even if certain articles in this terms of use are deemed as invalid or unable to enforce by the court, other articles will be valid and be applied to the case.
